3.2 Performing and Administering Contracts
Where you buy or sell goods through an Infinity auction, information may be processed where necessary to administer and perform the relevant contractual arrangements.
Infinity acts as auctioneer and agent for sellers in accordance with our Terms & Conditions.
The contract for the purchase and sale of a lot is formed between the seller and the successful buyer.
3.3 Preventing Fraud and Protecting Our Services
We may process information to verify users, investigate suspicious activity, prevent fraudulent bidding or account misuse, protect buyers and sellers, maintain platform security, prevent cybercrime and investigate unauthorised activity.
3.4 Enforcing Our Terms & Conditions
We may process and retain information where necessary to investigate breaches, pursue unpaid invoices or charges, respond to claims, resolve disputes, establish or defend legal rights and provide evidence in legal proceedings.
3.5 Improving Our Website and Advertising
We may use website and campaign information to understand:
- which auction categories attract interest;
- which pages and lots visitors view;
- how visitors arrive at our website;
- whether advertising campaigns result in website visits, registrations or other relevant actions;

Where this activity involves non-essential cookies, pixels or similar tracking technologies, we will obtain consent where required by law.
4. Our Lawful Bases for Processing
Depending upon the circumstances, we may rely upon one or more lawful bases.
Contract
Processing may be necessary to provide our services, administer your account or perform contractual arrangements relating to an auction transaction.
Legal Obligation
We may process information where required to comply with legal, accounting, tax, regulatory or statutory obligations.
Legitimate Interests
We may process information where necessary for our legitimate business interests, provided those interests are not overridden by your rights and interests.
Our legitimate interests may include operating and improving our auction services, maintaining accurate records, fraud prevention, account security, enforcing contractual rights, debt recovery, preventing misuse, business administration and appropriately marketing auction services to businesses.
Consent
Where consent is legally required, including for certain electronic marketing and non-essential cookies or tracking technologies, we will rely upon your consent.
You may withdraw consent at any time.
Withdrawal does not affect processing that was lawful before consent was withdrawn.
5. Auction Focus and Auction Marketing
5.1 Auction Focus
Auction Focus is an auction marketing service used to promote relevant forthcoming auctions, lots and auction-related opportunities.
Infinity may use Auction Focus to communicate information concerning categories including plant and machinery, commercial vehicles, agricultural equipment, industrial assets, business assets, liquidation and insolvency stock, overstock and wholesale goods.
Auction Focus may also feature relevant auctions operated by other auction businesses where this is permitted by applicable law.
5.2 Information Used for Marketing
Information used for auction marketing may include your name, business name, email address, telephone number where appropriate, auction interests, previous auction engagement and marketing preferences.
We do not sell your personal information to advertisers.
5.3 Corporate Business Contacts
Where an electronic contact address belongs to a corporate subscriber, such as a limited company or limited liability partnership, we may send relevant B2B auction marketing where permitted by law.
Where information relates to an identifiable individual business contact, we will also ensure there is an appropriate lawful basis under applicable data protection legislation.
Marketing communications will identify the sender and provide an appropriate means of opting out.
The ICO currently distinguishes corporate subscribers from sole traders and certain partnerships for electronic marketing purposes. ([ICO][2])
5.4 Sole Traders and Individual Subscribers
Sole traders and certain partnerships are treated differently from corporate subscribers under the Privacy and Electronic Communications Regulations.
Where consent is legally required before sending electronic marketing to an individual subscriber, we will obtain appropriate consent unless another lawful exemption applies.
Consent to marketing will not be assumed merely because you visit our website, create an account, bid in an auction or accept our general Terms & Conditions. ([ICO][3])
5.5 Opting Out
You may stop receiving marketing communications at any time by using the unsubscribe facility in the relevant communication or contacting us.
Where you unsubscribe, we may retain a limited suppression record so that your preference continues to be respected.
Opting out of marketing does not prevent us from sending necessary service communications concerning an auction, bid, invoice, payment, collection, security matter or transaction in which you are involved.
6. Meta Pixel and Meta Advertising
6.1 What Is the Meta Pixel?
Infinity may use advertising technology provided by Meta Platforms, including the Meta Pixel and, where implemented, Meta’s Conversions API.
These technologies help us measure the effectiveness of advertising shown through services such as Facebook and Instagram.
They may also help us understand whether a person who sees or interacts with an Infinity advertisement subsequently visits our website or performs another relevant action.
6.2 Information the Meta Pixel May Collect
Depending upon your device, browser, cookie choices and the way our Meta integration is configured, information processed through Meta advertising technologies may include:
- your IP address;
- browser and device information;
- the page or lot you visited;
- the date and time of the visit;
- the referring website or advertisement;
- website interaction information;
- campaign or advertising identifiers;
- cookie or device identifiers; and
- events such as visiting an auction page or other website activity.
Where additional Meta features such as Advanced Matching are enabled in future, additional information may be transmitted to Meta in a protected or hashed format where permitted by law. We will ensure that appropriate transparency and lawful processing requirements are met before enabling such functionality.
6.3 Why We Use Meta Advertising Technology
We may use Meta advertising technologies to:
- measure whether our advertising is effective;
- understand how visitors interact with Infinity following an advertisement;
- attribute website visits or relevant actions to advertising campaigns;
- measure auction and catalogue engagement;
- create advertising audiences;
- show relevant Infinity advertising to people who have previously interacted with our website where permitted;
- exclude existing audiences where appropriate;
- improve future advertising campaigns; and
- understand the overall effectiveness of our marketing.
6.4 Consent for the Meta Pixel
The Meta Pixel is treated by Infinity as a non-essential marketing technology.
Where consent is required under applicable UK law, the Meta Pixel and other non-essential Meta advertising technologies will not be activated until you have provided the appropriate consent through our cookie controls.
Simply continuing to use our website will not be treated as consent to marketing cookies.
The ICO states that non-essential cookies and similar technologies should not be placed before valid consent has been obtained and that consent requires a clear positive action. ([ICO][1])
You may withdraw or change your cookie preferences at any time through the cookie preference controls available on our website.
6.5 Information Received by Meta
Where Meta advertising technology is activated, certain information may be transmitted to Meta Platforms.
Meta may process information for purposes described in its own privacy information and business tools terms.
Depending upon the circumstances and the particular processing involved, Meta may process information as a service provider to Infinity or for its own purposes under its applicable privacy arrangements.
We do not control all processing performed independently by Meta.
6.6 Meta Retargeting
Where you have consented to the relevant marketing technologies, we may use Meta advertising features to show Infinity advertising to people who have previously visited or interacted with our website.
For example, a visitor who views an Infinity auction catalogue may subsequently see advertising relating to that auction or similar auction categories on Facebook or Instagram.
You can withdraw your website marketing-cookie consent through our cookie controls. You may also be able to control advertising preferences through your Meta account settings.
7. Sharing Information
We do not sell your personal information.
We may share personal information where reasonably necessary with:
- our auction and bidding platform providers;
- website, hosting and IT providers;
- advertising and analytics providers, including Meta Platforms where the relevant technology is enabled;
- Auction Focus for permitted auction marketing;
- professional advisers;
- accountants and auditors;
- fraud prevention and identity verification providers;
- debt recovery providers;
- legal representatives;
- regulators;
- law enforcement bodies;
- courts and tribunals; and
- other service providers reasonably necessary to operate our business.
Where another organisation processes personal information on our behalf, appropriate data protection arrangements will be maintained where required.
8. Buyers and Sellers
Infinity acts as agent for sellers.
Where a successful auction transaction takes place, relevant information may be disclosed between the buyer and seller where reasonably necessary to complete or administer the transaction.
This may include information necessary for identification of the contracting parties, collection, release of goods, delivery where separately agreed, VAT or export documentation, resolving queries or dealing with disputes.
We do not make bidder personal information generally available to other website users.
Information will only be disclosed where reasonably necessary for the transaction, administration of the auction, enforcement of rights or compliance with law.
9. Bidding and Technology Providers
Infinity uses third-party technology providers to operate online bidding, auction catalogues, bidder accounts and related functionality.
This currently includes technology integrated with our website, including BidJS where applicable.
These providers may process information necessary to provide their services.
Where they process information on our behalf, appropriate data protection obligations will apply.
Where a provider acts as an independent data controller, its own privacy policy may also apply.
10. International Transfers
Some of our technology, advertising or service providers may process information outside the United Kingdom.
Where personal information is transferred internationally, we will take appropriate steps to ensure that the transfer complies with applicable UK data protection law.
This may include relying upon UK adequacy regulations, approved contractual safeguards, the UK International Data Transfer Agreement, an approved UK Addendum or another recognised lawful transfer mechanism.
11. Data Security
We take reasonable technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse, alteration, disclosure and destruction.
Access to personal information is restricted to persons who reasonably require access for legitimate business purposes.
You are responsible for keeping your account password and login information confidential and should notify us promptly if you believe your account has been compromised.
No internet-based system can be guaranteed to be completely secure, but we take reasonable measures appropriate to the information we process.
12. How Long We Keep Information
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected and to comply with legal, accounting and contractual requirements.
Transaction, invoice, auction and contractual records may typically be retained for up to six years following the relevant transaction or the end of our relationship.
Information may be retained for longer where reasonably required for legal proceedings, unresolved disputes, debt recovery, fraud prevention, tax or regulatory requirements or another legal obligation.
Identity verification information will not be retained for longer than reasonably necessary for the purpose for which it was obtained.
Marketing information may be retained while you remain a relevant business contact or until you object, withdraw consent or unsubscribe, as applicable.
A minimal suppression record may be retained after an unsubscribe request so that we do not inadvertently contact you again.
13. Cookies and Similar Technologies
Our website uses or may use cookies, pixels and similar technologies.
Cookies are small pieces of information stored or accessed on your device which can enable website functionality and provide information concerning how the website is used.
Strictly Necessary Cookies
These are required for security, account functionality, bidding services, cookie preferences or other essential website features.

These may help us understand how visitors use the website, identify website problems and improve our services.
Where legally required, analytics technologies will only operate after appropriate consent.
Marketing and Advertising Cookies
Marketing technologies may be used to measure advertising, understand campaign effectiveness, build relevant audiences and provide advertising.
These may include the Meta Pixel.
Where consent is required, marketing cookies and pixels will not be activated until you have expressly selected or accepted the relevant category through our cookie controls.
You may change your cookie preferences at any time.

Our website may contain links to websites or services operated by other organisations.
Where you leave our website and access another organisation’s service, that organisation’s privacy policy will normally apply.

If you ask us to stop using your personal information for direct marketing, we will stop the relevant processing.
You may still receive communications necessary to administer your account or transaction, including bidding notifications, invoices, payment reminders, collection instructions, security messages and correspondence relating to a purchase, sale or dispute.
